Nalbandian has lost all his prize money and Ranking Points for the whole Tournament

A stunned and angry McDougall :roll: then rolled up his trousers to reveal a bloody gash on his leg before remonstrating with Nalbandian.
Nalbandian was immediately disqualified "due to unsportsmanike behaviour" and Cilic was declared the champion.
The Argentine was stripped of his runners-up cheque, worth €44,945 ($A57,000), and 150 ATP ranking points, which he would have earned as a beaten finalist.

He could also be hit with a €10,000 fine, which will be decided by ATP chiefs at a later date.
But he could also face an eight-week ban having also been fined $8000 for throwing water at an Australian Open tournament worker in January following a five-set defeat to America's John Isner.

Just heard on the news that the line judge has made a complaint of assault to the police :roll: .....he must be sniffing compo here

The ridiculous part is, this was clearly an accident. He kicked the hoarding. You could maybe shoehorn a bit of reckless in there, but it's marginal

Not necessarily kicked but if a player had fallen onto it then it could have had the same result : it's positioning could be argued, albeit creatively, to have been unsafe.

Does it really compare to the huge holes (photographers pits) that, amazingly, sit just behind the goal lines at some modern football grounds (including Citeh??). If a player went down one of them after a tackle they really would have reason to sue.

On holiday I sat down on what I thought was the sofa but turned out to be the arm which had a very sharp metal corner. Basically my full weight on my coccyx from standing on a 5mm metal spike.

Suffice it to say it's the closest I've come to shedding a tear in pain in many, many years! Two weeks later and I'm still in pain when moving from sitting to standing and vice versa, especially when lifting weights.

p.s. rolling around or not, it deserved the initial punishment and possibly more, especially considering Nalbandian's comments after the incident. I agree that part of the fine should go directly to refunding the supporters who were the other victims.

I think he'll be very likely to be allowed to play at Wimbledon, I really do. He might even be advised to pull out.

The principle of Res Ipsa Loquitor says there's a case.
Bolton v Stone would ask whether it was reasonably foreseeable.

That's just about the extent of my memory of Tort exams. I'm sure a legal eagle would rip that to shreds in no time :lol:
