A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.

If he genuinely believes he is acting honestly he might get away with it - though the goods would have to be returned.

Be suprised if it got that far.

Can't even do that with my vouchers. They stopped accepting vouchers last night. Told to try again in a few weeks.
How much in vouchers do you have?

If for example you have £20, go into your local HMV, select £20 worth of goods (nothing more), provide the voucher to the cashier, they'll refuse it, you refuse to return the goods. No criminal offences at least not until you step outside the shop premises with the unpaid for goods in your possession, civil dispute only for which they'd have to take you to court for which obviously isn't going to happen. Job done.
If youre talking about theft then you dont even need to leave the store for the offence to be complete.

But in my argument, Not if the buyer genuinely believed that the voucher formed part of that payment.

But surely a) there would be signs and b) the assistant would point it out immediately. At this point there can be no doubt.

Ignorance is no defence as you say but it's hardly clear cut - the CPS would have to be sure of the conviction, lets see -

R-v- Little Timmy and his Nan's gift - Snaresbrook Crown Court, Monday 10:00.

I know what i would be backing as a result.

It probably would as you'd have to break into the store in the first place

If you're suggesting that as a result of HMV having gone under, then I'd say there'd be no complainant, therefore no IP (victim), therefore no offence

In these specific circumstances I suspect you'd get away with it, but under contract law you've not formed a contract, the goods still belong to the shop and its clear cut theft, whether or not the person knows the law or not.

The fact that you wouldn't get 'done' doesn't mean you've not committed a crime.

Are the stores still trading here? I didn't think they were but the Irish one must be open for that story to have happened.

If they are trading and not taking vouchers then they are really taking the pi$$ and deserve all they get.

Euro Truck Simulator 2, The Sims 3 Town Life and Rail Simulator.
Tbh stealing these games shouldn't be a crime in the first place.

Playing those games should be a crime.

Buying them for your grandchild should be classified as child abuse.

He still paid £39.00, if he had got those 3 titles through Amazon.UK it would have been £36.21 including postage. Some people never learn.

HMV administrators Deloitte today confirmed that all proceeds from the sale of 'He Ain't Heavy, He's My Brother' will go to the Hillsborough families' fight for justice.

Liverpool Walton MP Steve Rotheram contacted the administrators last Friday to ensure all money made from the sale of the charity single would go to the families.

Joint administrator Nick Edwards said: "I can confirm that all money raised by HMV for various charities will be paid in full."
