Some help needed.

My girlfriend's sister has just moved into a new house and has signed her assured short-hold tenancy agreement.

However, she has been there two weeks and the neighbour across the road has a unhealthy obsession for her three year old son and has tried to take him out of the garden, is constantly knocking on the door to play with him and keeps asking if he can stay at her's to watch Ben10.

She has been told by other neighbours that the woman has a social worker and is not right in the head.

Should the estate agent have told her about this neighbour if they were aware?
Is yes, is this a breach of contract under caveat emptor 'let the buyer beware'

If your girlfriend's sister asked the estate agents about the neighbours and they said that they were fine, then she can look into it as we believe there are steps that she can take. due to giving incorrect information.

However, if she didn't ask the question, then the estate agents weren't actually lying by not answering the question.

Main concern is the previous tenant moved due this neighbour as she feared that this woman would harm her children.

Surely the estate agent knowing that my girlfriend's sister had children, should have informed them.

It does sound rather iffy, and it's probably worth her getting a free 30 minute consultation with a solicitor.

We all know that Estate agents are lacking certain morals. Interesting to hear what a solicitor would have to say.

Suggest to her that she should take her rental agreement/contract with her to the solicitor to see if she has any sort of get out clause.

She does really need to know where she stands legally. Chances are the police already know about this woman, and whilst she should talk to them, I am not sure what they can do to help her.

If she has a case against the Estate Agents, or wants to break her contract due to the problems with said neighbour, she is going to need to know sooner rather than later.

Precis. Talk to a solicitor and the police.

Girlfriend has come home today and said the woman has been knocking on the door again today.

William (the child) spoke to her through the letter box and she was trying to invite him around to hers.

Found out she was moved from her previous house due to her issues.

What does it say in the rental contract ?

If you were buying a house, then you should declare any nuisance neighbours. I don't think that this applies to rentals though :|

The Estate Agents will be acting on behalf of a landlord/landlady. It might be worth trying the EA to get in touch with the landlord to explain the problem. If this is going to effect future potential rental income, then no doubt the landlord will want the problem neighbour dealt with and fast.

How about trying your local MP ? This is what they are there for.....

Definitely an interesting one.

Estate Agent admitted today that they were aware there was an issue, but thought the woman had stopped.

Worth speaking ot the local crisis team to see if she is known to them (Hospital mental health people) They may not knowwhat she is doing and can arrange a visit. It's a slow process, but they usually get there in the end.
Also speak to your local neighbourhood police team. They may well be able to tell you more

If she has an assigned social worker, if you ring up (the crisis team) and mention the fact that you believe the kid is at risk, they will be round sharpish.

With so much emphasis on children's welfare nowadays, no one wants to drop a bollock in that regard.

Also - if she already has a social worker, its not as if they will have find someone to allocate it to.

Furthermore, at least your sister might find out what the woman's issue really is i.e. is she a threat to the child? Just because she likes children, she isnt necessarily a paedo and/or a risk in some other way. Although whether they would come out to your sister is another matter.... i.e. the lady is their concern, not your sister. So whilst they may come and see the neighbour, tell what she can/cant do - ive no idea if they'd speak to your sister directly (you'd assume so, to get some background).... or if they thought the woman herself was at risk (as a result of her actions).

Whats more important.

Risking the childs safety because of some nutter or a few hundred quid deposit.


Get out of there and worry about the deposit later.
